(SLAPTA MEILĖ MB, we; collectively, the “Parties“ and each a „Party“) in connection with your use of Slapta meilė's website www.slaptameile.lt (the "Website") to place orders.
1.2 By placing an order on the Website, the Customer confirms that he/she has read and agrees to be bound by these Terms and Conditions and the Slapta meilė Privacy Policy, which can be found here.
1.3 In the event that any of the terms and conditions mutually agreed between the Parties may be interpreted as conflicting, the following hierarchy of priorities will be followed for the purposes of interpretation and application of the provisions of the terms and conditions of the terms and conditions of the terms and conditions of the terms and conditions of the Terms and conditions of this E-Commerce; (i) these Terms and Conditions of E-Commerce; (ii) the Privacy Policy and the Cookies Policy; and (iii) the Terms and Conditions of Delivery and Returns. 1.5 Only persons aged 18 years and over may purchase goods from Slapta meilė. If the Buyer is under 18 years of age or is a minor in the area in which the Buyer resides, in which case the Buyer may not place an order at any time and in any manner. By placing an order on the Website, the Buyer confirms that he or she is at least 18 years of age or has been authorised to place an order by his or her parent or legal guardian who is at least 18 years of age and has accepted these Terms on your behalf.
1.6 Slapta meilė reserves the right to unilaterally change these Terms and Conditions and the prices of the Products for the purposes of its efficiency, competitiveness, further development and supplementation of the range of products, or for the purposes of reorganisation. Changes and additions to the Terms and Conditions and the prices of the Products shall become effective upon publication of this information on the Website. If the Buyer has placed an order before the amendments to the Terms come into force, the order shall be subject to the terms and conditions in force at the time of placing the order, except where otherwise provided by law or these Terms and Conditions.
2. Placing an order
2.1 The Buyer selects the goods, the available delivery and the method of payment. After making all the necessary selections and filling in all the required information, the Buyer confirms the placing of the order.
2.2 Once you confirm the placing of an order and click the Purchase button (the moment the order is placed), the order is submitted to Slapta meilė for processing and cannot be changed. „Slapta meilė will only process the order if the entire purchase process and order placement has been properly completed and there are no error messages on the Website.
2.3 If Slapta meilė decides to accept the order, the Customer shall be provided with an invoice together with these Terms and Conditions and the Privacy and Cookie Policy at the email address provided by the Customer to Slapta meilė.
2.4 Upon receipt of payment for the Goods, Slapta meilė shall send a confirmation email to the Buyer's email address and shall send the Goods by the delivery method chosen by the Buyer when placing the order.
3. Price of goods
3.1 The prices of the products sold on the Website are quoted in euros, excluding delivery costs. All prices are inclusive of VAT 21%. The delivery costs provided for in the choice of delivery method are added to the price of the product.
3.2 Slapta meilė reserves the right to adjust prices. If the Customer has successfully placed an order prior to the price change coming into effect, the Customer shall be charged the price quoted at the time the Customer confirms the placing of the order.

4. Shopping
4.1 The price or range of goods is subject to change depending on the availability of goods at the time and without prior notice. If the Buyer has placed an order prior to the change in the relevant terms and conditions, the Buyer shall be bound by the Terms and Conditions in force at the time of placing the order.
4.2 If the order cannot be fulfilled, the Buyer will be contacted by email and the amount paid will be refunded to the bank account from which the Buyer paid.
4.3 Slapta meilė aims to provide as accurate information as possible. We make every reasonable effort to accurately state the characteristics of our products, including composition and colours. The colour you see will depend on your computer system and we cannot guarantee that your computer will display these colours accurately.
5. Delivery
5.1. FREE DELIVERY IN LITHUANIA
Orders of EUR 100 or more are delivered free of charge in Lithuania, except in Curonian Spit. For purchases up to EUR 100, a delivery fee applies. For delivery in Curonian Spit, regardless of the amount of the order, there is a delivery fee of 15 EUR. If the buyer wishes to have the goods delivered outside the territory of Lithuania, an additional delivery fee will be charged, depending on the size of the parcel and the address.
5.2. DELIVERY TIME
After payment, your order will be delivered by DPD courier within 1-3 days. Delivery of orders is available from Monday to Friday. Orders placed on Friday after 12 noon will be dispatched on Monday of the following week.
6. Returns
6.1 When concluding a distance contract, i.e. when making a purchase on the website, you as a consumer have the possibility to exercise the right of withdrawal and unilaterally terminate the contract within 14 calendar days from the date of receipt of the goods, without giving any reason.
6.2 If you wish to return the goods you have ordered, you may do so within 14 days from the date of delivery. The packaging of the goods must be intact and the products unused. The goods can be returned by post to Sodybų 7a, 13277, Vilnius, Lithuania.
6.3 If you exercise your right of withdrawal, MB SLAPTA MEILĖ must refund the money to the same bank account from which the goods were paid for as soon as possible, but no later than 14 calendar days from the date of receipt of the returned goods and after having ascertained that they are of the same quality. If you wish to return an item purchased using an electronic gift voucher, the refund will be made to the purchaser of the gift card and not to the actual recipient of the item (the person who purchased the goods with the gift card).
6.4 The returned goods must be in the original packaging in good working order, as received from us. The goods must be in good condition (clean, with intact labels, protective films and other accessories typical of the original equipment).
6.5 In the event of a return of an order, the delivery charge is non-refundable.
6.6 If you have purchased a ticket for a regular experience (e.g. excursion, dinner, etc.) and your plans have changed, you will not receive a refund (according to Art.6.22810 para.12 of the CC, consumers cannot cancel contracts for accommodation, transport of goods, car rental, catering or leisure services if the contract specifies a specific date or period of time for the provision of the services). Refunds for tickets purchased for regular experiences are available in cases where the event is cancelled, rescheduled and the new date or venue offered is not suitable for you.

7. Personal information
7.1 Slapta meilė shall use the personal data and information on purchases made by the Customer in accordance with the applicable regulations on the processing of personal data to the extent necessary for the execution of the order placed by the Customer or if there is a legal basis for this. „Slapta meilė may transfer the Buyer's personal data to third parties, such as companies providing postal services, to the extent necessary for the delivery of goods to the Buyer.

8. Quality guarantee
8.1 Slapta meilė shall be liable for non-conformity of the purchased goods for a period of 2 years from the date of delivery of the goods to the Buyer. For the purposes of the sale of the goods to the User, any non-conformity arising within 1 year from the date of delivery of the goods to the Buyer shall be presumed to have existed at the time of delivery, provided that such presumption is not inconsistent with the nature of the goods or with the nature of the non-conformity. The Buyer shall inform Slapta meilė of the non-conformity, i.e. lodge a complaint, immediately within 2 months of its discovery and at the latest within 2 years of delivery.
8.2 Slapta meilė shall not be liable for damages or any other consequences arising from inaccurate information provided by the Buyer, including delayed delivery, if the damages are caused by circumstances beyond Slapta meilė's control.
8.3 Slapta meilė shall not be liable for any damages caused by improper use or storage of the goods ordered by the Customer.
8.4. The Buyer may file a complaint by contacting „Slapta meilė“ using the contact information provided above, via email at [email protected]. Please indicate in your complaint the name and contact details of the Buyer, the date of the complaint, the defect in the goods and the content of the complaint, and attach a proof of purchase.
8.5 Without prejudice to any consumer rights, all disputes arising between Slapta meilė and the Buyer shall first be settled by negotiation.
8.6 If the Buyer is a Consumer and has contacted Slapta meilė in writing in accordance with the procedures set out in these Terms and Conditions, but Slapta meilė has not satisfied or has partially satisfied the Buyer's claims, the Buyer may also lodge a complaint about the product purchased in the online shop:
- The State Consumer Rights Protection Authority (https://www.vvtat.lt/en/how-to-submit-a-request/734) at Vilniaus g. 25, 01402 Vilnius, Lithuania or by e-mail to[email protected]; or
- through the European e-dispute resolution (e-Dispute) platform (europa.eu/consumers/odr).
8.7 Relations between the Parties shall be interpreted and disputes between the Parties shall be settled in accordance with the law of the Republic of Lithuania in the courts of the Republic of Lithuania.
8.8 The Buyer shall also have other remedies, such as the right to claim damages, to withdraw from the Contract, to claim a reduction in the price or to claim interest in the event of delay.
8.9 Slapta meilė shall not be liable for any non-conformity of the goods:
- If the non-compliance is due to misuse or negligent maintenance or repairs carried out by someone other than our company;
- If the non-compliance is due to water or fire damage or other circumstances beyond the manufacturer's control.
8.10 Nothing in these Terms shall exclude or limit Slapta meilė's liability in respect of any matter for which it would be unlawful for us to limit or exclude our liability.
8.11 Slapta meilė accepts no liability arising out of or in connection with these Terms for loss of use, lost or inaccurate data, loss of revenue, failure of security mechanisms, business interruption, delay costs or any indirect, special, incidental, reliance or consequential damages, even if advised of the possibility of such damages in advance.
8.12. „Slapta meilė shall not be liable for consequential damages which are a side effect of the principal loss or damage, such as loss of income or opportunity; or for non-delivery of goods, or failure to perform any of our other obligations under these Conditions, where the failure to perform such obligations is due to circumstances beyond our reasonable control, including, but not limited to, fire, flood, windstorm, storm, riot, civil commotion, civil commotion, war, nuclear accident and acts of terrorism.
8.13. „Slapta meilė shall not be liable for any failure or partial failure to perform its obligations under these Terms and Conditions if such failure or partial failure is due to extraordinary circumstances which we could not foresee, avoid or remedy by any means whatsoever (Force Majeure). In such a case, the period of performance of our obligations under these Terms shall be extended until such time as the force majeure circumstances no longer prevail.
8.14. Our maximum liability to you for any loss or damage arising out of your order on the Website shall be limited to the full price of your order.
9. Other conditions and rules
9.1. Ownership of rights
9.1.1 We own and retain all right, title and interest in and to our intellectual property included on or made available through the Website and/or relating to our products or goods. No ownership rights and/or licenses in any intellectual property are transferable to the Buyer, regardless of the use of terms such as „purchase“ or „sale“. Our intellectual property may only be used by third parties if written approval has been obtained from us prior to use for any purpose.
9.2 Other conditions
9.2.2 Slapta meilė wants to provide the best possible online experience. In order to make this possible, Slapta meilė needs to ensure that our services run smoothly. Therefore, the Customer understands and agrees (i) not to post, transmit, distribute, upload or host any messages or content that could damage or adversely affect Slapta meilė's business, products or services; (ii) not act in a manner or use any means that restricts, interferes with, interferes with, or prevents any other user from using the Website, or that affects the security of the Website; or (iii) not use or attempt to use any tool, software, application, agent, script or other tool or mechanism (including, without limitation, spiders, crawlers, bots, avatars or intelligent agents) to browse or search the Website or copy content from the Website. „Slapta meilė reserves the right to immediately suspend access to the Website and terminate the account of any user who violates this provision or commits any other material breach of these Terms.
9.2.3.In matters not regulated in these Conditions, the Buyer and Slapta meilė shall be governed by the laws and regulations in force in the Republic of Lithuania regulating their mutual relations.
